Terms and conditions of service
An agreement concluded by paying a deposit by the Guest (hereinafter Client) whose deposit is paid for the service, and Madonna PMU-Art Kft. (based at Budapest, 1052, Régi posta utca 4.) (hereinafter: Service Provider) for Permanent Make-Up treatment:
1. /Client orders the following permanent make-up treatment (hereinafter: treatment)
acknowledging the conditions below:
First session: analysing style and character, and making shape design
This session includes the following:
– planning a permanent make-up, creating an exact shape by the cooperation of the client and the permanent make-up artist and
– creating a shape design, expressely approved by the Client with his/her signature, which contains the price payable for the service, whose sum shall be acknowledged by the Client expressely with his/her signature, and – base pigmentation
Service provider shall give information on the following:
a./ concerning symmetry, analysing the shade of the skin and the involuntary mimicry is a task of outmost importance where
– from the side of the service provider, a permanent make-up expert shall participate in revealing the involuntary mimicry, but the mimicry shown by the client during the design work may be taken into account, so it is the client’s mimicry shown during the planning shall constitute the base of the design, – even if the mimicry is revealed to the maximum extent during the design work, max. 95% of symmetry can be achieved and the judgement of symmetry is subjective as it is to be observed on a
surface dynamically changing its position.
b./ The result of a permanent make-up treatment is influenced by former permanent make-ups,
especially – in its hue and balance they can have such effects that can only be partly expected in advance as the new design may touch areas with former one colour or multicolour permanent make- ups and other areas that have not been treated earlier, – old permanent make-ups may lead to harsh spotty pigmentation if they show through the new one.
In these cases Service Provider shall not take any responsibilities for the consequences.
c./ furthermore, the result of permanent make-up treatment are influenced by the following factors:
– colours will modified in the skin, they may show unique hues on each person and
– the durability of pigmentation is affected by many factors such as skin type, outside factors, taking medicines, or metabolic processes or the effects of hormones. As these factors are out of the control of Service Provider, service Provider shall take no
responsibilities for their consequences.
d./ The risks involved in point b./ can be reduced to minimal by removing the former permanent make-up with laser, as this treatment removes the pigments after 1-10 sessions in 98% of the cases, making it possible to create a new permanent make-up with the desired result. This treatment can also be ordered and for the two treatments together a reduced price may be required. (If the laser removal is made by the Service Provider, Service Provider shall only undertake the creation of a permanent make-up if its result is deemed to be optimal to achieve the desired permanent make-up.)
Second session: pigmentation stabilizing colour
This session includes the following:
– observing reactions, an analysis of the hues of the base pigments made visible with refraction, added to the skin tone,
– conservation of the result of pigmentation by applying cover pigments with a shade dominating on the surface, so it is possible to pigment with the same shade or a different from the one used at the first session in a manner agreed in with the Client
At the second session it is not possible to work out a new design, its possibility and the payable extra fees for it are subject to a preliminary agreement between the parties.
Further sessions:
The pigmentation of 3 rd -5 th generation permanent make-ups should be upgraded for various reasons. Nevertheless, the remains of former pigments in the skin add up, therefore a laser removal might be necessary on one or two occasions during pigment upgrading. To achieve continuous quality permanent make-up a customized professional recommendation may be requested of the Service Provider (recording the details of any further pigmentation and/or laser removal) at any time following the second session at a discount price, and the Service Provider will suggest it in justified cases on the second occasion and in case Client should refuse to accept it, Service Provider shall not take any responsibility for a lasting and adequate result.
Any further session shall incur extra fees, the price of the treatment ordered at the first session shall not include the price of these further treatments.
2./ The treatment detailed in point 1./ is to be ordered from the Service Provider in writing, by paying the required deposit and recording the date of the first appointment.
The time and date of the first appointment may be modified once within 3 working days without any extra fees. The ordered treatment shall be paid at the first appointment with the deposit subtracted from it.
In case of any modification within 3 working days, a part of the deposit named when the appointment is made shall be considered as the fee of the modification of the appointment, whereas the rest of the deposit shall be subtracted from the price of the treatment. If Client fails to appear at the agreed time or after one rescheduling, Service Provider shall be entitled to keep the deposit, it shall not be repayable. For the service ordered at the first appointment, no additional sum is payable apart from the price paid then, if a second appointment is made within 60 calendar days for a date within 90 calendar days from the first appointment.
If a second session is requested more than 60 calendar days following the first occasion but within 80 days’ time, Service Provider shall be entitled but not obliged to provide a second appointment within 15 days after the receipt of the request. In each case that has not been mentioned heretofore, a separate, previously set fee may be charged by the Service Provider for the provision of a second appointment or for any colour stabilizing pigmentation made beyond the deadline, or Service Provider shall not be obliged to comply with the request for a second appointment.
Service Provider shall not be obliged to comply with any request for rescheduling an appointment if the request is sent within 24 hours ahead of the agreed appointment. For any rescheduling made within 24 and 48 hours before the appointment or if accepted, within 24 hours, Service Provider shall be entitled to charge an extra fee of which Client is previously informed. If Client fails to appear at the previously agreed time of the second appointment without any notice, then Service Provider shall be entitled to charge an extra fee for the second treatment to be performed at a later point in time or Service Provider shall not be obliged to provide a second appointment.
Service Provider shall issue an invoice for the price of the treatment with the data given to Service Provider unless any special request is expressed by Client concerning the invoicing data.
3./ Service Provider shall give information that a permanent make-up treatment takes 2-3 hours on each area, and the work, which is usually performed on two areas, shall take 4-5 hours. Service Provider shall do her best to achieve the desired result, the treatment plan shall be worked out with the help of the professional competence of the Service Provider in accordance with the desired result. If the treatment plan is not accepted by Client, they are entitled to refuse to conclude the agreement, nevertheless, in this case they forfeit the deposit. Client shall acknowledge that depending on the biological reaction ability of the body and the unforseeable risks, the expected result may differ from the average, and for such deviations no remedy can be requested, especially a refund. The treatment plan shall be worked out according to the professional competence of the Service Provider. Concerning that the result of the treatments may be judged differently by each person, Service Provider shall not take any responsibilities in case of aesthetic complaints.
As Client I hereby declare that I fully understand the factors influencing the result of the treatment, and having understood these factors, I require the treatment. As Client I recognise that during the treatment if the performing person decides so, Service Provider shall be entitled to interrupt the treatment, to continue it at another time or, in an extreme case, to abort it. This fact Service Provider shall be obliged to record in the documents together with the reasons for deciding so (the momentary health condition of Client, their illness, Client being under influence of alcohol or any other thing, other disturbing factors etc). Client shall be entitled to comment on this note in writing.
4./ As Client, I fully understand the aftercare regulations for the duration of regeneration after the treatment, I undertake to perform them, and I differ from the prescribed regulations only at my own risk (washing, scratching, UV rays may destroy the result) but for any problems and consequences arising from the failure to observe the regulations, Service Provider shall not take any responsibility at all. As Client I understand that a permanent make-up shall be protected from the effects of UV radiation beyond the duration of the regeneration process with a sunscreen of 50 SPF.
5./ As Client I hereby declare that the information I have given on my health conditions are true to the best of my knowledge. I hereby accept that for any problems or complications arising from information kept secret or falsified or given falsely Service Provider shall not take any responsibility. As Client I hereby declare that I have given all relevant information necessary for the performance of the treatment, especially on my earlier illnesses, medical treatments, medicines or products with
healing effects I have taken, and their health risks. As Client I hereby declare that I have given all the relevant information, in connection with my illness(es), on everything that may endanger other people’s life or health, especially on contagious diseases and on illnesses or health conditions that prevent me from doing any job. As Client I hereby acknowledge that if the information and conditions I received before signing this document are different from those in the documents filled in and received here, it shall be the content of the signed documents that are relevant concerning the legal relationship and the ordered treatment. As Client I hereby declare under penalty of perjury that I have signed this agreement and other documentations containing all the information held relevant by me, which I received today in accordance with my intentions without being mistaken, deceived or threatened; without being forced or influenced; in full capacity of my mental and physical faculties and so I expose myself to the treatment.
7./ As Client I hereby declare that the information provided in this document is true and correct and I can be contacted through the contact details I have given. I give my consent to my details being recorded and stored by the Service Provider, and I also promise to inform Service Provider on any possible changes. If any data given earlier should differ from those given here, I hereby declare that the data given here are the valid ones. I hereby accept that Service Provider is not obliged to check if the data given by the Client are true or correct. If the data are partly or entirely not true or correct, or Client cannot be contacted through them, or any later change of the contact data has not been communicated to the Service Provider, Service Provider shall not take any responsibility for any damages or legal consequences resulting from the aforementioned factors. As Client I hereby declare that by giving my data, I am entitled, or with my consent a third party is entitled, to use them. As Client I hereby declare that the Service Provider shall not take any responsibilities for any abuse or unauthorized use of the registered data. As client I hereby declare that I am over 18 years of age, or if not, the treatment can be performed on me with the consent of my legal representative.
8./ Service Provider shall manage any information on the personality or health conditions of the Client communicated to the Service Provider in connection with the treatment or the legal
relationship as confidential. Service Provider, when managing the personal and other data given by Client, shall always comply with the data protection policies in effect, data management being connected to the treatment and the legal relationship.
9./ Service Provider shall be entitled to send news letters or other information or advertisement letters (hereinafter: Commercial materials) to Client if Client has given their previous, clear, expressed and voluntary consent by providing the necessary data. Client shall be entitled to withdraw her/his consent in writing at any time. In this case Service Provider shall not communicate any Advertising material to Client and shall cancel Client’s data from the relevant lists.
10./ If there is any discrepancy between the ordered treatment recorded in the design plan and the treatment, as Client I hereby accept that I shall be obliged to inform Service Provider on it in writing or personally with photos, in a justified, clear and identifiable manner (time, performed treatment, name given here, email address, phone number etc.) on the 14 th calendar day the earliest and on the 20 th calendar day the latest after the treatment. Client shall be obliged to indicate if they have any observation on the colour of the permanent make- up on the 21 st day the earliest and on the 30 th day the latest following the treatment in a manner described in the above paragraph. As Client I hereby acknowledge that if I do not notify Service Provider until the aforementioned time, the performed treatment shall be considered as being in complete accordance with the shape design and Clent’s expectations.
On any communication or complaint made by the clients, Service Provider shall respond in writing within 8 days, which shall contain Service Provider’s expert opinion if necessary. Service Provider has a professional trade insurance with MKB Biztosító Zrt (1133 Bp. Váci út 133) and the liabilities and right enforcement are subject to the business policies of the insurance company in effect.
11./ Service Provider shall perform the treatment professionally, complying with all the regulations, professional policies and protocols.
12./ As Client I hereby acknowledge that any damage caused to the Service Provider’s reputation or any slander may incur legal consequences, redressing any complaint made after the treatment is the common goal of the Client and the Service Provider. I acknowledge that any complaint can only be managed according to the manner described in this document, made in writing, after all the personal identification data have been given. As client I hereby acknowledge that even in case of any complaint made in connection with the treatment, I forebear to commit any infringement of law (harming reputation, slander) in writing, especially on electronic interfaces (such as Facebook, forums) or I shall promptly comply with the Service Provider’s written notifications concerning this. Furthermore I hereby give my irrevocable consent to Service Provider to post an objective opinion or protest with anonym data but responding to a concrete complaint on the given site in connection with my electronic statement, fully or partly revealing to the public the facts, information and photos concerning the treatment to the necessary extent if need be in case I fail to comply with the notification voluntarily and in due time. I hereby irrevocably and unconditionally order the treatment to be performed at my own risk, understanding the aforementioned conditions and the factors influencing the result, and I shall pay the price and other fees and undertake to fulfil my obligations incurred by this legal relationship.
